If an unmarried parent/principal owns a house & signs it over to a child/agent via “Durable power of attorney” in which the parent stipulated therein 👉🏾”in the event of my total incapacitation &/or demise my son John Doe shall continue to maintain total power control & /or possession of any & all properties belonging to me as though it was his own & to distribute same accordingly within his own sound discretionsaid agent shall also make gifts exceeding the amount of $500” would this qualify as a trust or form of will for the purpose of gifting the house without having to pay the 50 or 55 federal gift tax for the child/agent to immediately receive the house as a gift? I think you guys are conflating gift tax and estate tax Gift tax IS subject to a gift tax for amounts over the annual $15k exclusion, I just looked it up on the IRS website But you have to wait for someone to die before the estate tax rules and exclusions, which are considerably more than $14k, kick in Ramsey was talking about 'stepped up basis' but that doesn't apply if the value of the estate is under $114million per dead person (married couple can give away $228million on their death) Comment from : Scott Prost-Domasky |
